Cannabis State Laws

Federal lawCannabis is illegal under federal law. The government has listed cannabis as a Schedule I drug, under the Controlled Substances Act (CSA). This means they view cannabis as a dangerous, highly addictive drug with no medicinal value. Even though 39 states have medical cannabis laws, the CSA does not recognize the difference between medical and recreational use of cannabis.
State Law – Each state has their own rights and laws regarding medical and recreational cannabis. However, because cannabis is federally illegal, federal law enforcement officials may prosecute medical and recreational cannabis users, even if they reside in a state where it is legal and protected under state law. The decisions about prosecution are left to the discretion of the federal government. Many states have recognized cannabis’s value and have passed their own laws, regardless of federal law.

Hemp State Laws

Federal Law – Industrial hemp is known as Cannabis sativa L. and must have a THC threshold under 0.3%. The 2018 Farm Bill legalized the production of hemp as an agricultural commodity as well as removed it from the Controlled Substances Act (CSA). This bill allows states to regulate commercial hemp farming. For more information about the 2018 Farm Bill, click here.
State Law – Hemp production is legal in 46 states. The 2018 Farm Bill allows states like Idaho, Mississippi, New Hampshire and South Dakota to continue to ban the production of hemp within their state boarders.

CBD State Laws

Federal Laws – CBD is federally legal thanks to the 2018 Farm Bill, which legalized hemp and all hemp-derived products – like CBD containing 0.3% or less THC. 
State Laws – The 2018 Farm Bill gives states the rights to oversee hemp production as well as restrict it.  CBD’s legality can be affected by how it was made and its intended use. Most CBD products are sourced from hemp, which is legal in the majority of states. However, CBD can also be made from cannabis, which remains illegal in some areas because it contains THC.
